Construction reverse charge in Malta — what applies today

A careful guide for subcontractors and main contractors: normal VAT invoicing, the cross-border reverse charge, and how to check before issuing a zero-VAT invoice.

Some countries apply a domestic reverse charge to construction subcontracting, so the supplier issues an invoice without VAT and the customer accounts for it. For Malta we could not find an official rule that applies such a domestic reverse charge to ordinary construction services between two Maltese businesses. Commentary from advisers suggests Malta has not adopted a general domestic mechanism. What does exist is the reverse charge on services received from suppliers established outside Malta. If you are unsure, invoice with VAT as normal and ask the Malta Tax and Customs Administration in writing before you issue any invoice without VAT.

  • Domestic construction services between Maltese VAT-registered businesses: invoice with VAT at the applicable rate unless official guidance clearly says otherwise.
  • Services from a supplier abroad: the reverse charge can apply to the Maltese customer.
  • Services connected to land or buildings are generally taxed where the property is located.
  • Wrongly omitting VAT from an invoice can lead to an assessment, so get written confirmation if in doubt.

How it works

Identify the customer and the supplier: are both established and VAT-registered in Malta?

If yes, treat the invoice as an ordinary taxable supply: show the net amount, the VAT rate and the VAT amount on each line.

If the supplier is established outside Malta and supplies a service taxable in Malta, the Maltese customer accounts for VAT under the reverse charge, and the invoice should carry the appropriate reverse-charge wording.

If the works are on property located in another country, the place of supply is normally that country and Maltese VAT may not apply. See the related page on immovable property.

When a special scheme is claimed, keep the contract, the invoice and your correspondence with the authority, because they are the evidence in an audit.

Frequently asked questions

Is there a domestic construction reverse charge in Malta?

We could not confirm one in official sources. Do not issue construction invoices without VAT on that basis unless the Malta Tax and Customs Administration confirms it applies to your case.

What if I charged VAT by mistake?

Issue a credit note that references the original invoice and issue a correct invoice. Adjust the VAT in the period in which the correction is made.

Are materials and installation treated separately?

It depends on whether the contract is a single supply or separate supplies. Describe the supply precisely on the invoice and get advice for large or mixed contracts.

How is a real reverse-charge invoice shown?

The invoice states that it is subject to the reverse charge, shows the customer's VAT number and shows no VAT amount. The customer accounts for VAT on its own return.

Can 4invoices apply the reverse charge for me?

No. 4invoices does not decide the VAT treatment and does not select rates automatically. You choose the VAT rate on each line, including 0%, and can add a note. It supports any currency with an exchange rate and PDF download, with a 6-month free trial without a card.
